Bernhard Law Firm represented a property investor in his action for fraud, negligent misrepresentation, negligence, injunction and cancellation, slander of title, and violation of Florida Deceptive and Unfair Trade Practices Act against the financial servicing corporation. The facts underlying the investor‘s claims alleged that 16 different entities participated in widespread mismanagement and fraud relating to a security encumbrance.
Bernhard Law Firm‘s suit also alleged that most of these 16 companies had individually or collectively claimed ownership or rights to the security at issue, despite their patent factual and legal inability to have any such entitlement. These companies had individually or together attempted to collect on the security interest from the investor despite having no right to collect. The havoc and confusion created cost the investor substantial fees and lost investment. Accordingly, Bernhard Law Firm sought damages for his losses, an order enjoining the immediately culpable entities from continuing their fraudulent acts and requiring them to record a cancellation of their fraudulent security assignment documents, which the Court granted.
