THE FRAUD CASE – Inspector, Owner, and Association Misrepresentation in Brickell Penthouse Purchase

In T.L. v. B.S., Bernhard Law Firm filed an action for misrepresentation, breach of contract and warranties, and violation of the Florida Deceptive and Unfair Trade Practices and the Condominium Act, against two property inspection companies, a property owner, and an association, relating to purchase of a Brickell penthouse. As quoted from the pleadings:

This is the [the Purchaser’s] action . . . relating to ownership of the rooftop patio and balcony enclosure appurtenant to the [Penthouse]. Before purchasing the unit, the Defendants repeatedly represented—in communications, walk-throughs, deed, certificate, inspections, and reports—that the unit included this balcony enclosure and rooftop patio. The Defendants referred to the enclosure as a family room or bedroom, and in fact, the enclosure and patio appear to be just that. The condominium association issued a certificate that the unit, as constructed with this open and obvious balcony enclosure and rooftop patio, was in compliance with all governing documents. The inspectors and prior owner confirmed the same. However, after purchase of the unit the Association alleged that ownership of the balcony enclosure and rooftop patio was not as represented and made every effort to remove the enclosure and patio from the rest of the unit. As a result, the [Purchasers] have suffered significant losses.”
